Article 1: Order
Access to the site is free and free for all people. Any order on the site implies to have read these general conditions of sale and to have accepted them.
Poé Tahiti reserves the right to make changes at any time by publishing a new version of them on the site.
The general sales conditions applicable to the customer are those in force on the day of his order on the site. These conditions apply throughout the duration of online services offered by the site.
The acceptance of the general conditions of sale supposes on the part of the customer that he enjoys the necessary legal capacity for that. If the client is a minor or does not have this legal capacity, he declares to have the authorization of a guardian, a curator or his legal representative.
Poé Tahiti processes orders in the order of execution and within 2 days.
Article 2: Rates
The prices of the items are indicated in euro net of VAT (vat is not applicable according to article 293 B of the CGI), except participation in shipping costs.
Poé Tahiti reserves the right to change prices at any time. The products will be invoiced on the basis of the tariffs in force at the time of the validation of the order.
Article 3: Payment
The customer can make his payment by:
- Credit card
- Bank transfer
No data relating to the means of payment of the customer is collected by the site.
In the case of payment by check, payable to Poé Tahiti, the delivery times defined in Article 5 "Delivery and Transport Costs" of these general conditions of sale do not begin to run until the date of actual receipt of payment by the seller (without payment within 10 days the order will be canceled and the items will be put back for sale).
Article 4: Right of withdrawal
The customer can exercise his right of retraction according to the legislation in force (article L121-21 of the consumer code)
In case of exercise of this right:
-The communication of the withdrawal request must be made by e-mail, to Poétahiti@laposte.net within 14 days from the day of receipt of the order.
-The customer must return the item (s) in their pouch (s) fabric Poé Tahiti, all slipped in a padded envelope or wrapped in bubble wrap within 14 days from the day of communication by e-mail of his decision to retract.
-The return costs will be borne by the customer.
-The order will be refunded in the form of credit note.
-The costs of reshipping the new order will be borne by the customer.
Damaged or damaged items will not be picked up.
Article 5: Delivery and Shipping Costs
Packages are sent by “la poste” (lettre suivie, recommandé or colissimo).
Shipping costs are offered for a lettre suivie in France and outre-mer.
A tracking number is sent by e-mail as soon as the order is shipped so that the customer can track their routing.
The delivery time in France is generally 2 working days.
The letter suivie is delivered without signature.
For shipments outside France and outre-mer, please contact Poé Tahiti before ordering.
The order will be delivered to the address indicated by the customer when placing his order.
Poé Tahiti is not responsible for any delays in postal services, nor for address errors indicated by the customer when ordering.
Poé Tahiti is not responsible for the damage caused by the shipment. Items leave the shop in perfect condition and are carefully packaged in a suitable container.
Article 6: Litigation
Applicable law: this contract is subject to French law. The language of this contract is French. In case of dispute the French courts will be competent.
Article 7: Personal Data
The collected data are intended for use by Poé Tahiti. They are necessary for the processing and management of customer orders as well as the commercial relations between Poé Tahiti and the customer.
The collection of data is carried out in particular:
- when the user or the customer creates an account,
- when the customer places an order on the site,
- when the user or the customer contacts the customer service,
- when the user or the customer subscribes to the newsletter,
- when the user or the customer shares an article with a friend by sending an email,
- when the user or the customer shares an article via social networks.
The communication of personal data is a completely voluntary initiative on the part of the user.
The customer has the right to access, modify or delete his personal data by contacting Poé Tahiti through the contact form on the site. Poé Tahiti guarantees that in no case the personal data of users or customers.
